1. Acceptance of Terms

By accessing or using Tabak (“the Service”), provided by 3 Chiles Media Designs (“The Company”) you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you confirm that you meet this age requirement.

3. Account Creation and Management

• An account is automatically created on your behalf when you log in using any Auth0-supported authentication platform.

• Your email address, obtained from Auth0, will be used as your unique account identifier, but will never be stored in clear text.

• You are responsible for maintaining the confidentiality of your login credentials and are responsible for all activities conducted under your account.

4. Subscription and Payment

• Tabak offers two subscription levels: Personal and Community. See the About pagefor details regarding these subscription levels.

• Payments are processed through Stripe. All payment terms, including automatic renewals, are handled by Stripe.

• Trial Period: A one-month trial of the Personal subscription is available to new users. At the end of the free trial, users may opt to discontinue use of the service, or continue with one of the Personal or Community subscriptions levels.

• No Refund Policy: Payments are non-refundable. If you cancel, your subscription will remain active until the end of the current period, after which it will not renew.

• You may downgrade or cancel your subscription at any time.

5. User Content and Ownership

• All content you create or upload while using the Service (e.g., journal entries, collection details, and uploaded photos) remains your property.

• By posting content, you grant 3 Chiles Media Designs a non-exclusive license to store and display the content within the app while your subscription is active.

• If you cancel your subscription, your data may be retained in the event you decide to resubscribe at a later time. You may, however, upon request, have all data associated with your account irreversibly deleted.

• Community Sharing: If you hold a Community license, you may choose to share your content with other Community members:

  • Sharing is opt-in and you can control what aspects of your contributed content may be shared.

  • You are solely responsible for any content you share, and it must comply with these Terms.

• Tabak will never sell or use your content for promotional purposes.

6. User Conduct

You agree that you will NOT:

• Upload, share, or post any content that is obscene, offensive, or abusive.

• Harass, bully, or intimidate other members.

• Attempt to access or modify other members' data.

• Use automated methods (e.g., bots or scraping) to access the Service.

• Share content that infringes on intellectual property rights or contains malicious code.

7. Data and Privacy

• Your email address will be hashed and stored to associate your data with your account. The plain text version of your email address is never stored.

• Tabak collects data to provide services and improve functionality.

• Anonymous usage data may be collected through Vercel hosting for performance analysis and app improvement.

8. Health Disclaimer

Tabak provides a platform for managing cigar and pipe collections. You acknowledge that smoking cigars and pipes carries health risks. 3 Chiles Media Designs is not responsible for any health consequences resulting from your tobacco use.

9. Service Availability and Liability

• The Service is provided on a best-effort basis.

• While we aim to keep the Service available at all times, we make no guarantees regarding uptime or availability.

• 3 Chiles Media Designs is not responsible for any data loss or service interruptions.

10. Termination of Accounts

• 3 Chiles Media Designs reserves the right to terminate or suspend your account at any time if you violate these Terms.

• Upon termination, all associated data may be permanently deleted.

11. Disputes

Any disputes arising from the use of the Service or these Terms will be resolved at the sole discretion of 3 Chiles Media Designs. Our decisions regarding disputes, including but not limited to account suspensions and content removal, are final and binding.

12. Changes to Terms

• We may update these Terms from time to time.

• You will be notified of updates via the app or through email (if you have opted in to email notifications).

• Continued use of the Service after an update constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Texas and applicable United States federal law.
